CERTIFYPROFAST – TERMS & CONDITIONS

These Terms & Conditions (“Terms”, “Agreement”) govern your access to and use of CertifyProFast LLC’s websites, platforms, courses, products, services, content, and related applications (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and any policies incorporated by reference (including our Privacy Policy and Cookie Policy). If you do not agree with these Terms, you must not access or use the Service.

1. Definitions

1.1

“CertifyProFast,” “CertifyProFast.com”, “https://www.CertifyProFast.com”, “www. CertifyProFast.com”, “Company,” “we,” “us,” or “our” means CertifyProFast LLC.

1.2

“User,” “you,” or “your” means any individual or entity accessing or using the Service.

1.3

“Account” means a registered profile or login used to access the Service.

1.4

“Service” means all websites (including CertifyProFast.com), web or mobile applications, platforms, learning portals, courses, classes, modules, events, digital downloads, study materials, communities, communications, support, and any other products, services, content, or functionality provided or made available by Company, together with any updates, modifications, features, or enhancements.

“Content” means any text, graphics, charts, tables, videos, audio, assessments, software, or other materials made available via the Service.

1.6

“User Content” means any content submitted, uploaded, posted, or provided by you through the Service.

1.7

“Study Materials” means all course materials, recordings, documents, slides, handouts, question banks, mock test, assessments, and resources provided by CertifyProFast.

1.8

“Third-Party Services” means services, platforms, processors, or content provided by third parties and integrated with or linked from the Service.

1.9

“Personal Data” means information that identifies or can identify an individual.

2. Acceptance, Changes & Eligibility

2.1 Acceptance

By creating an Account, purchasing a product, or otherwise using the Service, you accept these Terms.

2.2 Changes

We may modify these Terms at any time. The “Last Updated” date reflects the effective date. Material changes may be communicated via the Service or email. Continued use after changes constitutes acceptance.

2.3 Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service.

2.4 Prohibition on Minors

The Service is not intended for individuals under 18. We do not knowingly collect data from minors. If you believe a minor has provided personal information, contact support@certifyprofast.com so we may delete it.

3. Accounts, Security & Acceptable Use

3.1 Registration

You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Security

You are responsible for safeguarding your credentials and for all activities under your Account. Notify us immediately of any unauthorized access or suspected breach.

3.3 No Sharing

You must not share your login or allow others to access the Service using your credentials.

3.4 Acceptable Use

You agree not to: (a) use the Service unlawfully; (b) copy, record, scrape, or harvest Content; (c) upload malware; (d) interfere with security or operations; (e) infringe intellectual property or privacy rights; (f) frame, mirror, or embed the Service without prior written consent; or (g) circumvent technical protections.

3.6 Suspension/Termination

We may suspend or terminate access if we believe these Terms are breached or security is compromised.

4. Access to Services, Scheduling & Changes

4.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service for your personal, non-commercial use.

4.2 Service Changes

We may modify, substitute instructors, reschedule, or discontinue offerings for operational or legal reasons. Where feasible, we will provide reasonable notice or equivalent alternatives.

4.3 No Guarantee of Results

We do not guarantee any particular outcome, such as certification exam success or employment results.

5. Pricing, Currency, Taxes & Billing

5.1 Pricing

Prices are displayed in U.S. Dollars (USD) or in your country-specific currency where regional pricing applies. Prices may vary by country due to taxes, exchange rates, or local billing policies.

5.2 Taxes & Fees

Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for paying taxes, duties, and charges as required by law.

5.3 Payment Authorization

You authorize us and our payment processors to charge your selected payment method for purchases, subscription and renewals (if applicable).

5.4 Non-Refundability

Except as expressly stated in Section 7, all payments are final and non-refundable.

5.5 Billing Errors

If you believe a billing error occurred, contact support@certifyprofast.com within 7 days for review.

6. Re-Enrollment & Course Access Policies

6.1 Re-Enrollment

Re-enrollment, extensions, or retakes may be offered subject to availability and additional fees.

6.2 Access Windows

Course or content access windows, if any, will be specified at purchase or in your Account.

6.3 Transfers

Transfers between cohorts or products may be limited and subject to administrative fees.

7. Refunds & Administrative Deductions

7.1 24-Hour Window

Refund requests must be submitted in writing to support@certifyprofast.com within 24 hours of purchase.

7.2 Administrative Deduction

Any approved refund will be processed to the original payment method and is subject to a twenty-percent (20%) administrative deduction to cover payment-processing and operational costs. Refunds are completed within 20 business days after approval.

7.3 No Refund After Access or Activation

No refunds will be provided once an Account is created/activated, paid content is accessed or viewed (even partially), or both.

7.4 Certificates/Completions

No refunds are available once any certificate of completion has been issued.

7.5 Local Consumer Rights

Where mandatory local consumer laws grant non-waivable rights, those rights will be honored to the minimum extent required by law.

8. Proprietary Use of Study Materials & Intellectual Property Rights

8.1 Ownership

The Service and all Study Materials are owned by CertifyProFast or its licensors and are protected by IP laws.

8.2 No Copy/Record/Distribute

No content from any platform operated by CertifyProFast may be copied, recorded, screenshotted, shared, transmitted, distributed, reproduced, uploaded, posted, published, stored, sold, sublicensed, displayed, or otherwise used without prior written consent.

8.3 Personal License Only

Your license is personal and non-transferable for your own learning purposes only.

8.4 Enforcement

Unauthorized use may result in termination, fee recovery, and legal action.

8.5 Trademarks & 8.6 Feedback

All names, logos, and marks are trademarks of CertifyProFast or their owners. Ideas or suggestions you submit may be used by us without restriction.

9. User Content & Community Features

9.1 Responsibility

You remain responsible for your User Content and necessary rights.

9.2 License to Company

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use and display such content to operate and improve the Service.

9.3 Moderation & 9.4 Prohibited Content

We may remove content that violates these Terms or law.

10. Privacy, GDPR/CCPA/VCDPA Rights & Cookies

10.1 Privacy Policy

Our collection and use of Personal Data are described in our Privacy Policy.

10.2 Your Rights

You may request access, correction, deletion, object to processing, or withdraw consent at any time by contacting privacy@certifyprofast.com.

We may use third-party processors and transfer data internationally with safeguards. See our Cookie Policy for details.

11. Confidentiality & Data Security

11.1 Confidentiality

Each party must treat non-public information as confidential.

11.2 Security

We implement reasonable organizational and technical security measures.

11.3 Exclusions

Obligations do not apply to public, independently developed, or lawful third-party info.

12. Third-Party Services, Links & Disclaimers

12.1 Third-Party Services

We don’t control third-party content, policies, or practices.

Use third-party services at your own risk. Links do not imply endorsement.

13. Indemnification

You agree to defend, indemnify, and hold us harmless from claims arising from your use of the Service, your User Content, or your breach of these Terms.

14. Disclaimers & Warranties

The Service and Study Materials are provided “as is” and “as available” without any warranties; we do not guarantee outcomes, availability, or that content constitutes professional advice.

15. Limitation of Liability

To the fullest extent permitted by law, CertifyProFast and its affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages. In no event will our aggregate liability exceed the amount you paid for the product or service at issue, less a 20% administrative cost deduction.

16. Governing Law, Venue & Litigation Radius

These Terms are governed by the laws of the Commonwealth of Virginia, USA. Venue for any dispute lies exclusively in the competent state or federal courts in Virginia, and both parties submit to their jurisdiction.

17. Force Majeure, Assignment & Miscellaneous

Neither party is liable for delays or failures due to causes beyond reasonable control. You may not assign these Terms without our consent; we may assign without restriction. If any provision is invalid, the rest remain effective. Failure to enforce is not a waiver. These Terms (plus referenced policies) are the entire agreement.
